TERMS GOVERNING USE BY CUSTOMERS

  1. Definitions
    1. "Company" shall refer to Hopstick Technologies Private Limited, a private limited company engaged in the business of Restaurant & Food Aggregation marketplace operating under the brand name of Hopsticks & Pondy Pass.
    2. "Pondy Pass" shall refer to a Tourist Pass issued by Hopstick Technologies Private Limited
    3. "Customer(s)/Your/You" shall refer to the users/holders of the Pondy Pass.
    4. "Terms" shall refer to these terms governing service providers.
    5. "Service Provider(s)" shall refer to various businesses engaged in various service areas such as food and beverage, adventure sports, tourism and hospitality etc. in Pondicherry and who have partnered with the Company in order to be a part of Pondy Pass.
  2. Terms and Conditions
    1. These Terms shall govern your use of the Pondy Pass issued by the Company.
    2. It is hereby clarified that the Pondy Pass does not guarantee a Customer access/prioritised access to any particular Service Provider’s services or amenities. Access is subject to the sole discretion of the Service Provider and other terms contained herein below in these Terms.
    3. Possession of the Pondy Pass does not guarantee to a Customer the entry or access to a certain Service Provider’s premises or services. The Service Provider shall have the right to refuse to provide you with services or refuse entry into the premises of their business at its sole and absolute discretion and the Company shall not be liable or responsible for the same.
    4. THE CUSTOMER SHALL BE REQUIRED TO STRICTLY ADHERE TO THE HOUSE RULES OF THE SERVICE PROVIDER. In the event that a Customer refuses to abide by such rules and regulations of the Service Provider, Service Provider shall reserve the right to refuse to provide you with their services and/or restrict your entry into their premises at their sole and absolute discretion.
    5. Customers to please note that the discounts and offers made available to them under Pondy Pass is subject to availability at the Service Provider’s end and the same are not guaranteed to be made available to the Customers at all times.
    6. Pondy Pass does not provide any guarantee as to the quality and standards of the services provided by the Service Providers and the Company shall not be liable to address any complaints or grievances of the Customers whatsoever. The Company shall under no circumstance be responsible or liable for any actions or omissions of the Customer or the Service Provider. The Company shall not be made a party to such matters in any manner whatsoever.
    7. The Customer hereby undertakes not to commit any inappropriate, obscene, or illegal acts or omissions at the premises of a Service Provider’s business or while receiving their services. The Service Provider will have the right to take any action as it deems fit against the Customers in such instances, including not limited to taking legal action.
    8. The Company shall not liable for any injuries sustained, damages or loss incurred, or any other adverse consequences arising from the actions of the Service Provider. All such matters shall lie solely between the Customer and the Service Provider.
    9. The availability of services of certain Service Providers shall be subject to the weather conditions, environmental safety and other factors beyond human control. The Company shall not be liable in the event of any cancellations, unavailability or adversities in the light of such circumstances. Customer may take up any grievances relating to the same with the concerned Service Provider. This Terms shall be governed by the laws of India. Any matters between the Company and the Customer relating to or arising from these Terms and/or Pondy Pass shall be subject to the jurisdiction of courts at Pondicherry, India.
    10. The Company may amend these Terms at any time, at its sole discretion without notice. The Customers are advised to regularly check the Terms for any changes/updates. If the Customer has any objections to any changes or updates, they may send an email to [insert email ID] expressing their concerns.
    11. Acceptance of these Terms shall be through digital means and no physical signatures of any party shall be required whatsoever.
